Explanation:
The vehicle support team- operations, part of the United Kingdom Ministry of Defence (the 'Authority'), intends to extend the scope of an existing supply contract (advertised in OJEU on 12 April 2019 reference 700004659) with General Dynamics Land Systems - United Kingdom (the 'Contractor') for the manufacture and supply of the following 'Foxhound' items, such extension having an estimated total value not exceeding GBP 452 140.00 (ex-vat):
It is considered that this contract amendment may be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC and Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848) on the basis that for technical reasons the requirements may be met only by the Contractor. The Authority conducted a competition (advertised through the issue of a contract notice published in OJEU on (10 July 2020 reference 7000712372) for all these safety critical items, under a new contract procurement and the Contractor returned the only compliant, priced bid at tender stage in relation to that competition.
