Description of risks to contract performance

The value of the direct award would be circa £1.8 million and therefore above the light touch threshold of £663,540, as such, MOJ would need to be able to rely on the justifications contained in Schedule 5 of PA 2023 in order to directly award to an LA or to a private organisation/social enterprise e.g. evidence that this award used the 'Urgency Exemption' limb.

Extreme and unavoidable urgency

The direct award of library services to the supplier are strictly necessary for reasons of extreme and unavoidable urgency. This is because the authority has a statutory obligation to provide prison library services and service provision cannot disrupted. Given these reasons of extreme and unavoidable urgency, these services cannot be awarded on the basis of a competitive tendering procedure. The urgency is unavoidable as it is not attributable to any act or omission of the contracting authority and could not have been foreseen by the contracting authority. 8. The business owner's requirement is to maintain current delivery and system stability, with future contracts being based on the services currently delivered, with all Terms and Conditions and value remaining unchanged.
